Congressman Tom Emmer has reintroduced the Blockchain Regulatory Certainty Act (BRCA), a bipartisan bill co-led with Congressman Ritchie Torres. The legislation aims to clarify that crypto developers and service providers who do not hold custody of consumer funds should not be classified as money transmitters under current regulations.

The bill seeks to provide legal certainty for blockchain developers, miners, validators, and wallet providers offering non-custodial services. Emmer and Torres argue that unclear regulations are driving American crypto innovation overseas, and the BRCA framework has been refined based on prior feedback to balance innovation with oversight.
